Terms of Service
Effective date: October 5, 2025
Scope: These Terms of Service ("Terms") are a legally binding agreement between you ("you", "your", or "User") and Avego ("Avego", "we", "our", or "us"), the operator of the Avego mobile application and related services. By downloading, installing, accessing, or using the Avego application ("App") or any services offered through the App, you accept and agree to be bound by these Terms. If you do not agree with these Terms in full, do not access or use the App.
1. Overview and Purpose
Avego is a location-based social and dating service intended to help consenting adults meet and connect. The App enables users to create profiles, upload and share user-generated content (including photos and verification videos), browse other users' profiles, send and receive messages, use matching and discovery features, and access optional paid/premium features. These Terms explain user responsibilities, permitted and prohibited behavior, how we handle content and payments, and limits on our liability.
2. Definitions
- Account: The profile and credentials you create to use Avego.
- User Content: Any content you upload, post, send or otherwise make available through the App (including photos, profile text, videos, messages, preferences, and any other materials).
- Services: The App and any features, products, communications, or functionality provided through the App.
- Paid Features / Subscription: Any optional feature, service, or content offered in exchange for payment (including subscriptions, in-app purchases, premium features, boosts, etc.).
- Sensitive Personal Data: Personal data categories that are sensitive by nature (for Avego this may include sexual orientation, relationship status, and precise location coordinates when shared).
- Third-party Services: Services provided by other entities that may be integrated into the App for authentication, payments, analytics, hosting, or other functionality.
3. Acceptance and Changes to Terms
3.1 Acceptance
By creating an account, using the App, or otherwise accessing any Services you expressly accept and agree to these Terms and any additional policies incorporated herein (including our Privacy Policy and Community Guidelines). These Terms form a contract — read them carefully.
3.2 Updates
We may modify these Terms from time to time. We will give notice in the App and, where required by law, by other means. Changes become effective on the date stated in the updated Terms. Continued use of the App after the effective date means you accept the revised Terms.
4. Eligibility
4.1 Minimum Age
The App is available only to individuals who are 18 years of age or older. By using the App you represent and warrant that you are at least 18 years old.
4.2 Residence
Avego is intended to be used by residents of India. You represent that you are accessing and using the App from within India and will comply with local laws.
4.3 Registration Information
You must provide accurate, current, and complete information when creating your account. You agree to update your information to keep it accurate. You are responsible for any activity on your Account and for keeping your credentials secure. You must not create multiple accounts unless expressly permitted by the App.
5. Account Creation, Authentication & Security
5.1 Account Creation
Accounts may be created using an email address, phone number, or via a supported third-party authentication provider. You authorize us to access certain information from third-party authentication providers as permitted by that provider and applicable settings.
5.2 Verification
We may offer optional or mandatory verification features (for example, video verification) to confirm identity or authenticity. You may be required to submit photos or short videos for verification. Such verification materials will be stored in our systems as described in our Privacy Policy.
5.3 Account Security
You are responsible for maintaining confidentiality of your account credentials. Notify us immediately if you believe your account has been compromised. We are not liable for losses caused by unauthorized use of your account except where required by law.
6. User Content — Uploading, Storage & License
6.1 Scope
Avego allows and encourages Users to upload profile photos, bio text, interests, messages, and short videos for verification or profile purposes. All such material is "User Content."
6.2 Storage
User Content (including photos and verification videos) will be stored on our servers and/or third-party hosting services. By uploading content you consent to storage and processing as described in these Terms and our Privacy Policy.
6.3 License to Avego
By posting User Content you grant Avego a worldwide, non-exclusive, royalty-free, transferable license to host, store, distribute, display, reproduce, modify (for formatting), and otherwise use that content strictly for operating, improving, and promoting the Services (for example, to show your profile to other Users, to provide match recommendations, to perform analytics, or to moderate content). This license ends when you delete your content, subject to retention described below.
6.4 User Ownership
You retain ownership of your User Content subject to the license you grant to Avego. You represent and warrant you have all rights necessary to grant this license.
6.5 Right to Remove
We may remove, edit, or refuse to publish any User Content for any reason (including violation of these Terms), and we may suspend or terminate accounts associated with prohibited activity.
7. Prohibited Content & Conduct
You agree not to post or transmit any content that:
- • Is pornographic, sexually explicit, containing nudity, or intended to arouse sexual excitement. The App maintains a strict no-nudity policy; explicit sexual content or images are prohibited.
- • Encourages, depicts, or promotes illegal activity, violence, discrimination, or hate speech.
- • Is abusive, harassing, threatening, or intended to stalk, intimidate, defame, or humiliate another person.
- • Contains sexual solicitation of minors, or depicts or references minors in sexual contexts.
- • Violates intellectual property rights, privacy rights, or other legal rights of any third party.
- • Contains malicious code, spyware, or anything intended to impair or damage the App or another user's device.
- • Discloses another person's private information (personal contact details, identification numbers, financial information, etc.) without consent.
- • Attempts to misrepresent identity, age, location or other essential facts, or to impersonate another person.
User Conduct
In addition to content restrictions, you agree not to:
- • Engage in fraud, scams, catfishing, or any deceptive actions to obtain money, sexual favors, or other benefits.
- • Solicit or facilitate prostitution, escort services, or paid sexual services.
- • Use the App for commercial solicitations, advertising, or recruitment without prior written consent.
- • Scrape, mine, or harvest data from the App or attempt to reverse engineer its systems.
8. Moderation, Reporting and Appeals
8.1 Moderation
The App uses a combination of automated tools and manual review to moderate User Content and behavior. Moderation decisions may include content removal, warnings, suspensions, or account termination.
8.2 Reporting
Users may report profiles, messages, or content for violation of these Terms via in-app reporting mechanisms. When you report content, provide accurate details to help our review team.
8.3 Investigation & Action
Reported items are reviewed manually by our moderation team. We will take action if our review determines a violation has occurred. We do not guarantee the timing of review but will attempt to process reports promptly.
8.4 Appeals
If your content or account is actioned and you believe this was in error, you may submit an appeal through the in-app appeals channel. Appeals will be reviewed; we may reinstate content or accounts where appropriate.
8.5 Cooperation with Authorities
We may disclose User Content and account information to law enforcement or government authorities where required by law or to protect the safety of our Users or the public.
9. Safety, Meeting in Person & No Background Checks
9.1 No Background Check
Avego does not perform background checks on users as a default service. Verification features confirm the authenticity of photos or video materials but do not constitute a criminal background check or guarantee of a User's character or history. You should exercise caution when interacting with others.
9.2 Safety Tips
We encourage Users to follow safety best practices: meet in public places, inform friends/family about plans, avoid sharing sensitive personal information, and use the App's block and report features if you feel unsafe.
9.3 Blocked or Reported Users
You can block or report other Users; blocked Users cannot view your profile or contact you. Blocking does not, by itself, prevent a blocked User from seeing public parts of your profile unless you change your privacy settings.
10. Paid Features, Billing, Trials and Refunds
10.1 Paid Features
Avego offers optional Paid Features (subscriptions, one-time purchases, or credits) that enhance the user experience. Paid Features and pricing are described in the App.
10.2 Payment & Authorization
Payments are processed through third-party payment processors. When you authorize a purchase you represent you are authorized to use the selected payment method. All fees are quoted in the currency shown at purchase.
10.3 Subscription Terms
Where subscriptions apply:
- • Subscriptions auto-renew unless you cancel before the renewal date.
- • Renewal charges will be made to your selected payment method at the then-current subscription price.
- • You are responsible for cancellations in accordance with the cancellation procedure available in the App or billing platform.
10.4 Free Trials & Promotional Offers
If you are offered a trial period, you will be charged at the end of the trial unless you cancel before the trial ends. Offers are subject to conditions stated at the time of the offer.
10.5 Refunds
Refunds for Paid Features are handled in accordance with local consumer protection laws and the refund policies of the payment processor. Except where required by law, refunds are provided at our discretion and are not guaranteed. Charges for subscriptions already used are generally non-refundable.
10.6 Taxes
You are responsible for any taxes associated with purchases unless otherwise stated.
11. Privacy and Data Processing (Summary)
11.1 Privacy Policy
Our Privacy Policy (available within the App) explains in detail how we collect, use, share, and retain your personal information. You agree to that policy by using the App.
11.2 Types of Data Collected
We may collect contact information, profile data, User Content (photos, verification videos), messages, device information, approximate or precise location (if enabled), preferences, and certain Sensitive Personal Data you choose to provide (for example, sexual orientation or relationship preferences).
11.3 No Biometric Data
We do not collect or process biometric identifiers (such as fingerprint templates, face recognition templates, or iris scans) as part of our user verification or other features.
11.4 Sensitive Data Consent
Because some profile fields may be sensitive by their nature, when you provide such information you give explicit consent for us to process it for the purposes described (profile display, matching, and analytics). You may choose to leave sensitive fields blank.
11.5 Use of Location
If you enable location features, we may use approximate or precise location data to provide matching and discovery services. Location sharing is under your control and can be turned off in the App and device settings.
11.6 Retention & Deletion
We retain your data as long as necessary for the purposes described, including legal obligations and dispute resolution. When you delete your account, we will disable public access to your profile and content; we may retain copies for a period required by law, for backup, or for legitimate business purposes (e.g., fraud prevention). Exact retention periods are described in the Privacy Policy.
11.7 Data Security
We implement reasonable technical and organizational measures to protect data. However, no system is fully secure; we cannot guarantee absolute security and you agree to assume certain risks inherent in online services.
12. Intellectual Property Rights
12.1 Avego IP
The App, its design, features, algorithms, trademarks, logos, graphics, and content (other than User Content) are the proprietary property of Avego or its licensors and are protected by intellectual property laws.
12.2 User Content IP
You retain the intellectual property rights in the User Content you post, subject to the license granted to Avego in Section 6.
12.3 Feedback
If you provide feedback or suggestions about Avego, you grant Avego a perpetual, royalty-free, worldwide license to use and incorporate such feedback without obligation to you.
13. Third-Party Services & Integrations
13.1 Third-Party Authentication & Integrations
The App may allow authentication via third-party providers or integrate third-party services for payments, analytics, messaging delivery, or hosting. When you use such integrations, you authorize Avego to access the information necessary to provide the Service and you also agree to the third party's terms as applicable.
13.2 Responsibility
Avego is not responsible for the acts or omissions of any third party provider. If you choose to link, connect, or interact with third-party services, you do so at your own risk.
14. Copyright & Intellectual Property Complaints
If you believe content on Avego infringes your intellectual property rights, you may notify us via the in-app support channel with sufficient information identifying the allegedly infringing material and your contact information. We will investigate and take appropriate action, which may include removing or disabling access to the disputed material.
15. Disclaimers & Limitation of Liability
15.1 No Guarantees
Avego provides the Service "as available" and "as is" without warranty of any kind. We do not guarantee matches, relationships, or outcomes from using the App. We do not warrant that the App will be uninterrupted, error-free, or secure.
15.2 User Conduct & Safety
You acknowledge that interactions with other Users may carry inherent risks. Avego does not control the behavior of Users and is not responsible for the actions of third parties.
15.3 Limitation of Liability
To the fullest extent permitted by law, Avego and its affiliates, officers, directors, employees, agents, and service providers are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the App, including but not limited to loss of profits, data, goodwill, or other intangible losses. Our aggregate liability for direct damages is limited to the amount you paid for Paid Features in the six months preceding the claim (or a nominal amount if you have not purchased Paid Features), except where applicable law requires greater liability.
15.4 Exceptions
Nothing in these Terms excludes liability for death or personal injury caused by our negligence or for other liabilities that cannot be excluded by applicable law.
16. Indemnification
You agree to indemnify, defend and hold harmless Avego and its affiliates, officers, directors, employees, agents, and licensors from any claim, demand, loss, liability, damages, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your User Content; (c) your violation of law or the rights of any third party; or (d) your use of the App.
17. Termination, Suspension and Account Deletion
17.1 Termination by You
You may delete your account at any time using the account settings in the App. Deleting your account will disable public access to your profile and may delete your content as described in the Privacy Policy.
17.2 Suspension or Termination by Avego
We may suspend or terminate your access to the App or delete your account without prior notice and for any reason, including but not limited to breaches of these Terms or suspected fraudulent or harmful activity.
17.3 Effect of Termination
Termination does not relieve you of obligations incurred prior to termination. Certain provisions (intellectual property, indemnity, limitation of liability, etc.) survive termination.
18. Dispute Resolution and Governing Law
18.1 Governing Law
These Terms are governed by the laws of India without regard to conflict of law principles.
18.2 Jurisdiction
Any dispute arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. You and Avego each submit to the jurisdiction of these courts.
18.3 Good Faith Resolution
Before initiating legal action, we encourage you to contact our support team to attempt to resolve disputes informally.
19. Consumer Rights
These Terms do not limit rights you may have under applicable consumer protection laws. Where such laws apply and are mandatory, those provisions will take precedence. Nothing in these Terms is intended to restrict the rights of Users under applicable law.
20. Notices and Communication
We may communicate with you via in-app notifications, email, or other contact information you provide. Notices to Avego should be sent via the in-App support channels or to our designated legal email: legal@avego.app. Communications are effective when received.
21. Miscellaneous Provisions
21.1 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
21.2 Assignment
Avego may assign its rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or as part of a corporate restructuring. You may not assign your rights under these Terms without Avego's prior written consent.
21.3 Entire Agreement
These Terms, together with any incorporated policies (Privacy Policy, Community Guidelines), constitute the entire agreement between you and Avego regarding the Services and supersede prior agreements.
21.4 No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
22. Community Standards and Responsible Use (Practical Guidance)
To help maintain a respectful community and reduce safety risks, the following practices are expected of all Users:
- • Use accurate, recent photos and truthful profile information.
- • Do not send unwanted sexual messages or images.
- • Do not pressure other Users into sharing private information or meeting in ways they are uncomfortable with.
- • Respect others' boundaries; if someone asks you to stop contacting them, do so immediately.
- • Use in-app safety features (block/report) to manage unwanted interactions.
- • If you believe a User may be dangerous or has engaged in behavior that could cause harm, report immediately and consider contacting local law enforcement.
23. Moderation Examples & Sanctions (Illustrative)
To provide clarity, examples of actions that may result in progressive sanctions (ranging from warning to permanent ban):
- • Warning: Minor community guideline violations (offensive language, single instance of harassment).
- • Temporary Suspension: Repeated harassment, posting borderline content, or multiple reports for inappropriate behavior.
- • Permanent Ban: Posting explicit sexual content (nudity), sexual solicitation, engaging in fraud/scams, impersonation, or any activity that endangers others.
Appeals can be made as described in Section 8.
24. Special Provisions for Sensitive Data & Preferences
24.1 Profile Visibility
You can choose what profile fields are visible to others. Sensitive fields are optional and remain private unless you choose to display them.
24.2 Matching Algorithms & Preferences
Avego may use preferences (including sensitive preferences) to calculate matches. You can turn off preference-based features where provided.
24.3 Children and Minors
If you believe a minor is using the App, please report immediately. Any account determined to belong to a person under 18 will be removed.
25. Security Incidents & Breach Notification
In the event of a data breach affecting your personal information, Avego will take reasonable steps to investigate and remediate the breach and notify affected Users as required by applicable law and as appropriate under the circumstances.
26. How to Report Abuse, Safety Concerns or Legal Requests
- • Use the in-app "Report" feature to report profiles, messages, or content.
- • For urgent safety concerns (threats of harm), contact local law enforcement immediately and provide them with any relevant information.
- • For legal requests such as court orders or subpoenas, provide them to our legal contact via the in-App legal channel or legal@avego.app.
27. Beta Features, Experimental Functionality & Service Changes
We may offer beta or experimental features. Such features may change, be removed, or behave unpredictably. Use of beta features is voluntary and subject to additional terms communicated at the time of feature access.
28. Promotions, Contests & User-Generated Events
Any promotions or contests run in the App will be subject to separate terms and eligibility rules posted at the time. Users agree to any additional terms and to release Avego from claims related to such promotions where permitted by law.
29. Recordkeeping & Compliance
We retain records of user transactions, complaints, and moderation decisions as necessary to comply with legal obligations, resolve disputes, prevent abuse, and for fraud prevention. We may anonymize and aggregate data for analytics and service improvement.
30. Summary of User Promises
By using Avego you promise and agree that you will:
- • Be 18 or older and use the App only in accordance with these Terms.
- • Provide truthful profile information and keep credentials secure.
- • Respect other Users and follow Community Guidelines.
- • Not post nudity, pornographic material, or solicit sexual services.
- • Use paid features honestly and understand billing rules.
- • Consent to the collection and processing of personal data necessary to provide the Services.
- • Cooperate with any investigations and respect moderation decisions where appropriate.

32. Final Notes
These Terms are written to provide clarity on how Avego operates, how your data is handled, and the responsibilities of both Users and Avego. They are intended to protect Users and the integrity of the community while enabling an enjoyable and safe experience. Please read these Terms along with our Privacy Policy and Community Guidelines. Using the App confirms you have read, understood, and agreed to all terms herein.

By creating an Account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any documents incorporated by reference.
